Terms of service

Effective date: 21 October 2026

OVERVIEW

Welcome to Locker Room Memorabilia. The terms “we”, “us” and “our” refer to Locker Room Memorabilia, an Australian sole trader business based in Geelong, Victoria.

These Terms of Service apply to your use of our website and purchases from us. Please read them together with our Refund Policy, Shipping Policy and Privacy Policy.

Our store is powered by Shopify. Purchases made through this website are made directly with Locker Room Memorabilia.

By using our website or placing an order, you agree to these Terms to the extent permitted by law. Our Privacy Policy separately explains how personal information is handled.

Nothing in these Terms or our policies excludes, restricts or modifies your rights under Australian Consumer Law or any other rights that cannot lawfully be excluded. This protection applies throughout these Terms, including Section 9.

SECTION 1 - ACCESS AND ACCOUNT

To place an order, you must be at least 18 years old or have the permission and supervision of a parent or guardian.

You must provide accurate, current and complete information when placing an order or creating an account, including your contact, billing and delivery details. You must be authorised to provide any personal information and use any payment method you submit.

If you create a customer account, keep your login details secure and contact us promptly if you suspect unauthorised access. You must not sell or transfer your account or allow another person to misuse it.

You are responsible for activity you authorise through your account. You are not automatically responsible for unauthorised activity merely because it occurs through your account.

SECTION 2 - OUR PRODUCTS

We aim to describe and photograph our products accurately. Colours may vary slightly between screens because of device settings and lighting. This does not affect your rights if an item does not match its description. Please read each listing carefully for the item’s condition, dimensions, authentication provider and included documentation. Unless stated otherwise, jerseys and photographs are supplied unframed.

Custom jerseys are non-licensed display jerseys. They are identified as custom in the relevant listings. Autograph authentication relates to the signature and does not, by itself, establish that an item is officially licensed, game-worn or player-used.

We may update listings or discontinue products. Changes to a listing after an order is placed do not alter the description or terms on which that order was accepted without your agreement.

SECTION 3 - ORDERS

Please check your order carefully before submitting it, including the items selected and your contact and delivery details. When you place an order, you are making an offer to purchase the items listed. We accept your order when we send your order confirmation email, following successful payment processing.

We may decline an order before acceptance where an item is unavailable, payment cannot be processed, we reasonably suspect fraud or unauthorised payment, or delivery is requested outside Australia. If this happens, we will notify you and promptly refund any payment received for that order.

If we discover a pricing or description error affecting your order, we will contact you to explain the error and give you the choice of proceeding on the corrected terms or cancelling the affected item for a full refund. We will not charge an additional amount or substitute an item without your agreement.

If you wish to cancel or change your order, please contact support@lockerroommemorabilia.com.au as soon as possible. We will try to accommodate your request, but changes or cancellations may not be possible once your order has been packed or dispatched.

Returns and refunds are explained in our Refund Policy. Nothing in these Terms or our Refund Policy excludes, restricts or modifies your rights under Australian Consumer Law.

SECTION 4 - PRICES AND BILLING

All prices are displayed in Australian dollars (AUD) and include any applicable taxes. Shipping charges are additional and are displayed at checkout before you submit your order.

We may change prices or introduce promotions from time to time. Price changes do not affect orders already accepted. If we discover a pricing error affecting your order, we will follow the process set out in Section 3.

Promotions may have additional conditions, including eligibility requirements and expiry dates. These will be disclosed with the relevant offer.

You agree to provide accurate, complete and current billing, payment and contact information when placing an order. Please notify us promptly if any details affecting your order need to be corrected.

You must be authorised to use the payment method provided. Payment must be successfully processed before we accept your order.

SECTION 5 - SHIPPING AND DELIVERY

We currently ship within Australia only. Shipping charges are displayed at checkout. Processing times, delivery estimates and other shipping details are explained in our Shipping Policy. Delivery timeframes are estimates rather than guarantees. If your order is delayed, missing or damaged during delivery, please contact support@lockerroommemorabilia.com.au so we can investigate and provide any remedy required under Australian Consumer Law. Nothing in these Terms or our Shipping Policy excludes, restricts or modifies your rights under Australian Consumer Law. Local pickup is not available.

SECTION 6 - INTELLECTUAL PROPERTY

Content on this website, including our original photographs, text, graphics, logos and website design, is owned by Locker Room Memorabilia or used with permission or as otherwise permitted by law. This content is protected by applicable intellectual property laws.

You may browse the website and share links to our pages and product listings for lawful purposes. Except as permitted by law, you must obtain permission from the relevant rights holder before reproducing, modifying, distributing or commercially using protected content.

Third-party names, trademarks and logos, including those of sporting leagues, teams, manufacturers, authentication providers and Shopify, remain the property of their respective owners. Their appearance on our website or products does not, by itself, imply sponsorship, endorsement or affiliation with Locker Room Memorabilia.

Purchasing an item does not transfer any copyright, trademark or other intellectual property rights in that item to you.

SECTION 7 - OPTIONAL TOOLS

Our website may provide access to optional tools or features supplied by third parties. Their use may be subject to the provider’s terms and privacy policy, which you should review before using them.

We do not control third-party tools and cannot guarantee their availability or operation. If you experience a problem with a tool that affects your order, please contact support@lockerroommemorabilia.com.au so we can assist.

Nothing in this section excludes, restricts or modifies your rights under Australian Consumer Law or our responsibility for obligations that cannot lawfully be excluded.

SECTION 8 - THIRD-PARTY LINKS

Our website may include links to third-party websites, such as authentication databases, manufacturer websites or player highlights. These links are provided for convenience and information.

We do not control third-party websites or their content. A link does not, by itself, mean that we endorse the website or its products or services. Please review the relevant website’s terms and privacy policy before providing personal information or making a purchase.

If an external link does not work, or you have difficulty verifying an item’s authentication details, please contact support@lockerroommemorabilia.com.au so we can assist.

Nothing in this section excludes, restricts or modifies your rights under Australian Consumer Law or our responsibility for our own products, descriptions or representations.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Locker Room Memorabilia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Locker Room Memorabilia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Locker Room Memorabilia, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Locker Room Memorabilia.

SECTION 10 - PRIVACY POLICY

Our Privacy Policy explains how Locker Room Memorabilia collects, uses, stores and discloses personal information, including information provided when you browse our website, place an order or contact us.

Our store is hosted by Shopify, which also collects and processes personal information to operate and provide its services. Shopify’s Privacy Policy explains its practices.

Personal information may be processed by Shopify and other service providers outside Australia. Please refer to our Privacy Policy for further details and information about privacy enquiries or complaints.

SECTION 11 - FEEDBACK

You may submit reviews, suggestions or other feedback about our products and services. Your submissions must reflect your honest experience, and you must disclose any incentive received in connection with a review.

You retain ownership of your content. When you submit a review for publication, you give Locker Room Memorabilia non-exclusive, royalty-free permission to reproduce and display it on our website and in marketing materials. We may format or shorten a review for presentation, provided we do not change its meaning or create a misleading impression.

We will seek your permission before publishing private correspondence, photographs you have not submitted for publication, or personal details beyond the display name accompanying your review.

You must have the necessary rights to submit your content. It must not contain unlawful material, misleading claims, malicious software or information that infringes another person’s intellectual property or privacy rights.

We may remove content that breaches these requirements. We will not remove a review merely because it is negative or edit it to misrepresent the reviewer’s opinion.

We may use suggestions to improve our products and services without an obligation to pay compensation, unless we have agreed otherwise.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We take reasonable care to keep our website accurate and current. Occasionally, errors or omissions may occur in product descriptions, prices, availability, promotions or shipping information.

We may correct website information when an error is identified. A correction does not automatically change the terms of an order we have already accepted.

If an error affects your order, we will contact you and follow the process set out in Section 3. We will not substitute an item, charge an additional amount or change agreed terms without your agreement.

Nothing in this section excludes, restricts or modifies your rights under Australian Consumer Law.

SECTION 13 - PROHIBITED USES

You must use our website lawfully and must not:

  • Place fraudulent orders, use payment methods without authorisation or impersonate another person.

  • Submit false or misleading information.

  • Harass, threaten or abuse any person through the website or related communications.

  • Infringe another person’s intellectual property or privacy rights.

  • Collect or misuse other customers’ personal information.

  • Upload malicious software, send spam or attempt to gain unauthorised access to accounts or systems.

  • Disrupt the website’s operation or bypass its security or access restrictions.

We may restrict or suspend access where we reasonably believe it is necessary to address a breach of these Terms, prevent fraud or protect customers and the website. Where appropriate, we will notify you and give you an opportunity to resolve the issue.

Any restriction or suspension does not remove your rights relating to an existing order, including rights under Australian Consumer Law.

SECTION 14 - AGENTS

If you use an automated tool or service to interact with our website on your behalf, you remain responsible for the instructions you give it and for ensuring its use complies with these Terms.

Automated tools must not bypass security measures, access accounts without authorisation, collect personal information unlawfully, place fraudulent orders or interfere with the website’s operation.

We may reasonably limit or block automated access where necessary to protect the website, customer information or the integrity of transactions.

Nothing in this section prohibits ordinary search engine indexing or the use of accessibility tools, provided they operate lawfully and do not compromise website security.

SECTION 15 - TERMINATION

You may stop using our website at any time and contact us if you wish to close your customer account. Closing an account does not automatically cancel an existing order.

We may suspend or terminate your account or access to the website where you seriously or repeatedly breach these Terms, or where reasonably necessary to prevent fraud, comply with the law or protect customers and website security.

Where reasonable and practicable, we will explain the reason and give you an opportunity to resolve the issue before terminating access. Immediate action may be necessary in cases involving fraud, security risks or unlawful activity.

Termination does not affect rights or obligations arising before termination, including our responsibility to fulfil accepted orders or provide any refund or other remedy required by law. Any cancellation of an order will be handled in accordance with these Terms and Australian Consumer Law.

Provisions that are intended by their nature to continue after termination will remain in effect, including those concerning intellectual property, permitted use of published reviews, outstanding payments and resolution of disputes.

SECTION 16 - CONSUMER GUARANTEES AND WEBSITE AVAILABILITY

Our products and services come with guarantees under Australian Consumer Law that cannot be excluded. Nothing in these Terms or our policies excludes, restricts or modifies those guarantees or any other rights or remedies that cannot lawfully be excluded.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

We take reasonable care in operating our website, but cannot guarantee that access will always be uninterrupted or free from technical errors. We may temporarily suspend access for maintenance, updates or security reasons.

Any interruption to website access does not remove our obligations relating to accepted orders or your rights under Australian Consumer Law.

SECTION 17 - LIMITATION OF LIABILITY

Our liability is determined by applicable law, including Australian Consumer Law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

We remain responsible for our own acts and omissions and for meeting our obligations relating to the products and services we supply. Using Shopify, payment providers, delivery carriers or other service providers does not remove those obligations.

You are responsible for losses to the extent they are caused by your fraud, unlawful conduct or breach of these Terms. You are not responsible for losses to the extent they are caused by us.

If a problem occurs, both parties should take reasonable steps to avoid or minimise further loss. This does not restrict any right to compensation or another remedy available under Australian Consumer Law.

SECTION 18 - INDEMNIFICATION

You may be responsible for reasonable losses or costs we incur from a third-party claim to the extent directly caused by your fraud, unlawful conduct or knowing infringement of that third party’s intellectual property or privacy rights when using our website.

You are not required to cover losses or costs caused by our own acts or omissions, or merely because you browse our website or purchase a product.

If we seek to recover costs from you in connection with a third-party claim, we will promptly notify you, provide reasonable details and give you a reasonable opportunity to respond. We will take reasonable steps to minimise those costs and will not agree to a settlement that imposes an obligation on you without your consent.

Nothing in this section excludes, restricts or modifies your rights under Australian Consumer Law.

SECTION 19 - SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be treated as removed to the extent necessary. The remaining provisions will continue to apply to the extent they can operate lawfully.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

If either party does not immediately exercise a right under these Terms, that does not mean the right has been waived.

These Terms, the policies they refer to and the agreed details of your order form the agreement between you and Locker Room Memorabilia concerning your use of the website and purchases from us.

Nothing in this section excludes responsibility for representations we make or affects any rights or remedies available under Australian Consumer Law.

SECTION 21 - ASSIGNMENT

If we transfer our business or our obligations under these Terms to another operator, we will take reasonable steps to ensure the transfer does not reduce your rights or adversely affect an accepted order. We will notify you if the transfer materially affects your order or customer account.

You may not transfer your customer account or contractual obligations to another person without our written agreement. This does not prevent you from giving away or reselling an item you have purchased.

Nothing in this section excludes, restricts or modifies your rights under Australian Consumer Law.

SECTION 22 - GOVERNING LAW

These Terms and purchases from Locker Room Memorabilia are governed by the laws of Victoria and applicable Commonwealth laws of Australia.

Disputes may be brought before the courts and tribunals of Victoria that have authority to hear them. Nothing in these Terms prevents you from bringing a claim in another court or tribunal where you have a legal right to do so, or restricts any rights under Australian Consumer Law.

SECTION 23 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE

We may update these Terms from time to time to reflect changes to our business, website or legal requirements. The current version will be available on this page, with the date it takes effect.

Changes will apply to use of the website and orders placed on or after that date. They will not change the terms of an order we have already accepted unless you agree or the change is required by law.

Where required by law, we will notify you of material changes.
